Terms of Service

These Terms of Service (“Terms”) govern your use of the Homeswapped platform operated by Momentum Holdings Group LLC (“Homeswapped,” “we,” “us”). By creating an account or using our services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally able to enter binding agreements to use Homeswapped. By creating an account, you represent that this is true.

2. The Platform

Homeswapped is a member stay marketplace powered by SwapKeys. Members can host to earn SwapKeys, then request eligible stays at verified homes. We are not a hotel, booking platform, or landlord. We do not own any properties listed on the Platform. Stay agreements are between members directly. Homeswapped facilitates introductions, quality verification, payments, and dispute mediation.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information in your profile and property listings. You may not create accounts for others without their consent or maintain multiple accounts. Impersonation, fraud, or misrepresentation are grounds for immediate account suspension.

4. Property Listings

When you list a property, you represent that: (a) you are authorized to offer the property for member stays (owner or authorized representative), (b) your listing accurately describes the property, (c) you will maintain the property to the standard shown at verification, (d) you will honor confirmed stays barring emergencies. Listings that misrepresent the property will be removed. Repeated misrepresentation will result in account suspension.

5. Stay Rules

All stay requests are subject to host acceptance. There is no obligation to accept any request. Once a stay is confirmed by both parties, cancellation may affect your hospitality score and eligibility for future stays. Members agree to treat each other's homes with care, to follow house rules provided by the host, and to leave the property in the condition in which it was found.

6. Fees and Payments

Membership fees, verification fees, and stay confirmation fees are stated in our Pricing page and are non-refundable unless otherwise specified. SwapKey purchases are non-refundable. Chargebacks or fraudulent payment disputes that are not resolved in good faith will result in account suspension. All fees are in USD.

7. Reviews and Scores

Homeswapped hosts a review system to help members make informed decisions. Reviews must be honest and based on your actual experience. We reserve the right to remove reviews that contain false information, threats, or personal attacks. Hospitality Scores are calculated from member reviews and verification assessments. Scores may not be disputed but will naturally update with new reviews.

8. Prohibited Conduct

You agree not to: use the Platform for any commercial rental or subletting purpose; collect or harvest other members' personal data; harass, threaten, or abuse other members; upload malware or interfere with Platform operations; attempt to circumvent security or access controls; use the Platform if you have been previously suspended.

9. Homeswapped's Role in Disputes

Homeswapped provides good-faith mediation for stay disputes. We do not guarantee resolution and are not liable for losses arising from member-to-member stays. For urgent safety issues, contact local emergency services first, then contact us at hello@homeswapped.com.

10. Intellectual Property

Homeswapped and its content (design, code, branding, written content) are owned by Momentum Holdings Group LLC. You retain ownership of content you upload (photos, descriptions, reviews) but grant Homeswapped a non-exclusive license to display that content on the Platform and in marketing materials.

11. Disclaimers

The Platform is provided 'as is' without warranties of any kind. Homeswapped does not warrant the accuracy of listings, the conduct of members, or the safety of any property. We are not liable for property damage, personal injury, or losses arising from member stays. We strongly recommend confirming your homeowner's insurance covers hosted stays.

12. Limitation of Liability

To the maximum extent permitted by law, Homeswapped's total liability for any claim arising from your use of the Platform is limited to the greater of (a) the amount you paid to Homeswapped in the 12 months preceding the claim or (b) $100 USD.

13. Governing Law

These Terms are governed by the laws of the State of Utah, United States. Any disputes will be resolved in the courts of Utah County, Utah, unless otherwise agreed.

14. Changes to These Terms

We may update these Terms. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
